PART 4
"AS IS" POLICY, QUALITY CONTROL & GRADING

" AS IS" POLICY: ITCCars Ltd. of Japan sells vehicles in 'as is' condition. Specifically, cars are sold as how they appear and are described in ITCCars website. 'as is' condition means that vehicles are sold in the exact state which they are in. Because of the nature of cars, it is difficult (almost impossible) to be aware of everything right and wrong with the car. Although ITCCars does its best in selecting quality cars and making necessary repairs, customers must always understand that there is risk associated with purchasing a used vehicle. ITCCars tries hard to reduce as much of this risk as possible by publishing to the website as much information about the vehicle as possible. However each used vehicle (even 5 grade or Excellent Condition) may require minor work after shipping and transportation.

We highly recommend all clients inspect or change the following parts of any vehicle (regardless of grade) before driving for best results. All liquids, including radiator water, engine coolant etc. as required in cold/hot climates, change the engine oil (sediment settling may occur in shipping and engine damage can occur), check transmission oil, power steering oil, brake oil & belts (like fan belt , AC belt etc.) also check and possibly change the battery. The necessary changes and amounts for these varies per vehicle and we estimate you can expect about US$ 50 to 500$ for each vehicle. For information on claims and warranty, please refer to section 7.

QUALITY CONTROL & LOWEST PRICES: Since the establishment of ITCCars Ltd. of Japan, our number 1 goal is to provide customers the highest quality vehicles with the highest quality service possible and the lowest possible prices. With this in mind, ITCCars has grown to be one of the largest automobile exporters in Japan. ITCCars uses very careful quality control measures to select its stock and publish its details to our customers.

ITCCars uses the highest standards to select our stock. We only select stock that qualifies in our grading system (described below) as GRADE 3 or above. After the cars are acquired and transported to ITCCars motor pool, they undergo a basic examination. Each vehicle is graded on two scales, INTERIOR CONDITION and EXTERIOR CONDITION. If the condition is unsatisfactory by ITCCars standards, ITCCars professional technicians will move the vehicle into ITCCars workshop for repairing or into the paint Shop for repainting if required.

All ITCCars cars undergo a mechanical inspection. Cars are checked for basic road function and road safety. Engine noise, AC, electrical function, lamps, brakes, clutch, steering etc. are all examined for basic functionality. This is only a simple mechanical inspection (is not an inspection done with dismantling). ITCCars recommends that customers always perform a full inspection after a ITCCars vehicle is received to ensure comfortable and safe driving. All ITCCars vehicles undergo a surface inspection. All glass parts are inspected and repaired or replaced if necessary. Plastic parts with obvious cracks are repaired or replaced. Any obvious dents and scratches are recorded (some may be repaired). All obvious blemishes (exterior and interior) are recorded. Car accessories and options such as stereos, heated seats, power options, fog lights, aftermarket parts etc. are checked and recorded. After the two inspections, final INTERIOR CONDITION and EXTERIOR CONDITION grade points are issued and all recorded information is published to our website. Photos are taken of the vehicle (front/side, back/side, interior, engine bay) and published to our website. Additional pictures are published occasionally depending on the vehicle.

Once a vehicle is ordered, cars undergo cleaning and a simple inspection before shipping. Cars are moved into ITCCars wash area. Interiors are cleaned with a vacuum machine (fabric seats may be steam cleaned). The car exterior is washed with an automatic washing machine. Engine bays are cleaned with a jet-cleaner and hand brushed. Afterwards, cars are checked again for basic functionality. This is only a simple inspection (is not an inspection done with dismantling).

ITCCars recommends customers always perform a full inspection after a ITCCars car is received to ensure comfortable and safe driving. To further improve ITCCars vehicles, ITCCars offers several optional service packages. ITCCars highly recommends purchasing these service packages because they will help ensure the customer a comfortable and safe vehicle. Service packages are conducted in Japan prior to shipping. Service packages can be selected within ITCCars online order form.

GRADING SYSTEM ITCCars uses the following grading system for customers to better understand the condition of our vehicles. Two grade points are given to each car listed in ITCCars website. One grade point refers to the vehicles exterior condition and the other refers to the interior condition. Customers must understand these grade points are only estimations by professional technicians and do not necessarily reflect the exact condition of the vehicle.

Funds required for deposit on purchase are sent to ITC by bank transfer (any bank charges are the customer’s responsibility) and are required to be transferred within validity period and any balance due thereafter within five days after shipment. Normal shipment period is three to five weeks after receipt of initial deposit but this depends of availability of vessels and space for the intended ports. Amount required for initial transfer depends on ITC’s sole discretion.

Important please note: sometimes we receive more than one order for a vehicle. In this case we follow "first come, first served" and the vehicle goes to the first clients whose transferred funds arrives and are confirmed arrived. We are not responsible if a client has sent funds but the desired vehicle has already has been sold. We do our best to prevent this from happening, but international banking differences, time differences and the instantaneous nature of internet processes sometimes allow this to happen despite our best efforts. Received amount will send back to clients account or the Client can choose another vehicle & received amount will apply to his/her new purchase.

STEP 7 - ITCCars WILL SHIP THE VEHICLE
After ITCCars has received the 'first' or deposit payment, ITCCars will begin shipping arrangements. In order to make the next available shipment, the payment must be received at least 6 working days before the scheduled *ETD date of a transport. If the payment is received after 6 working days, the vehicle must wait for the transport after the next available shipment. This 6 day period is necessary because the vehicle must be Prepared (inspected, cleaned), moved to the port, and processed for customs before it can be loaded onto the ship. ITCCars cannot be held liable if a shipment is missed for late payments, bank delays and shipping schedule changes. After a vehicle is shipped, the shipping information (ETD/*ETA dates) will be available in the customer's account reports.

STEP 8 - REVIEW BILL OF LADING
Within 5 working days after the ETD date, ITCCars will make available the vehicle's Bill of Lading online. This can be found by clicking on MY ACCOUNT. The customer must view and confirm that the Bill of Lading is correct. In any case, the customer may request changes to the Bill of Lading online. Each change made (per bill) will be subject to a charge of 10,000 YEN. ITCCars cannot be held liable for any errors in the Bill of Lading which may result in a delay to release the vehicle.

STEP 9 - SUBMIT FINAL PAYMENT
Once the Bill of Lading has been reviewed, customers must submit the 'final' payment (if any) which is the remaining amount of the Proforma Total. ITCCars recommends that this payment be made at least 2 week before the vehicle's ETA date of your port. This is to avoid any delay in the destination port--customers can then release the vehicle as soon as they arrive. If the payment is not received in this time, the customer must be aware of the destination port's storage policies. Customers are responsible for any storage (and any other) charges by the destination port that may occur if a vehicle is held. If the 'final' payment cannot be received within 1 month after the ETA date of an order or before the maximum amount of time for storage allowed by the port's customs authority, ITCCars reserves the right to auction that vehicle to any customers within the same destination port. Additionally ITCCars will confiscate the initial 'first' payment amount and apply cancellation fees & no refund claim will acceptable.

STEP 10 - DOCUMENTS WILL BE SENT TO THE CUSTOMER
After ITCCars has received the 'final' payment, ITCCars will send all necessary documents to release the vehicle (please see section 6). All documents will be sent by DHL or FEDEX ETC. Depending on the customer's location, the delivery can take between 5 to 10 working days. For our customer's convenience, the DHL or FEDEX etc. tracking number will be published in the customer's MY ACCOUNT as soon as the documents are sent. Customers may go to our website to view the status of their delivery. ITCCars cannot be held liable for any delays associated to wrong addresses or DHL/ FEDEX etc related problems.

PART 8
LIABILITIES, BASIC WARRANTY & PARTS SUPPORT

LIABILITY LIMITATIONS

ITCCars Ltd. of Japan customers understand that vehicles are purchased from ITCCars in 'as is' condition (please see section 4). ITCCars is responsible for the vehicle only up until the vehicle is released to the shipping company in Japan. ITCCars guarantees that the vehicle is released to shipping authorities in Japan in the same condition it appears as published on ITCCars website. ITCCars vehicles are always inspected twice (please see section 4), once after they have been acquired, and once again before they are sent to the shipping authorities for export.

ITCCars Ltd. is not liable for possible occurrences and/or deterioration after the vehicle has been received by the shipping authorities in Japan. Although very rare, ITCCars customers must always understand that there is a certain amount of risk associated with transporting vehicles overseas. Because overseas shipments may take longer than 1 month, additional wear may occur on the vehicle.

Additionally, there have been some reports of theft and mishandling by shipping authorities and customs agents. Customers must understand that although the majority of ITCCars sales proceed smoothly and problem free, risk is present in this type of business (not just limited to ITCCars Ltd.). The customer assumes this risk.

ITCCars registered customer has the responsibility to understand the necessary procedures & restrictions required to import a vehicle into the destination country. Many countries have various procedures & restrictions on vehicles (for example, import duty, year restrictions, cc restrictions etc.). The customer is assumed to realize these procedures & restrictions when conducting business with ITCCars. ITCCars cannot be liable for transactions stopped short due to the customer's misunderstanding of procedures & restrictions. In this event (depending on the progress of the transaction), cancellation charges may apply and/or no partial refunds may be given.

All other liability limitations written in this customer agreement apply.

ITCCars Ltd. will do everything possible to reduce the risk assumed by our customers. ITCCars quality control measures, careful planning and careful execution are all results of several years of experience in the export business. Customers concerned about any aspect of our services are welcomed to contact ITCCars anytime.

BASIC WARRANTY & REASONABLE CLAIMS

ITCCars Ltd. will only accept reasonable claims against its vehicles within 1 week after the arrival date of the vehicle at the customer’s port. Customers must understand that the 1 week period for claims begins as soon as the vehicle has arrived at the customer’s destination port. ITCCars customers are highly encouraged to make all necessary payments at the earliest possible time to avoid delay acquiring their vehicles. This strict policy is necessary because customers who delay their payments subject the vehicle to additional waiting (additional risk to the vehicle) inside the in-bond storage facilities within the port.

Reasonable claims made within 1 week after the arrival date will be honored by negotiation. Customers must supply proof (depending on the seriousness of the claim, for example pictures, inspection reports etc.) to ITCCars. Claims must meet two conditions. First, the proof must clearly show that the received condition is different from the condition detailed on ITCCars website. ITCCars maintains detailed records of each vehicle it handles; these records will be compared with the claims. Second, the damages must not have obviously occurred in transit overseas or within customs/port storage facilities.

EXCLUSIONS

Vehicle parts subjected to wear from day-to-day normal driving (such as brake pads, batteries, tires, oil quality, shocks, odometer etc.) are excluded from ITCCar's basic warranty. Theft of parts which obviously occurred in transit overseas or within customs/port storage facilities is also excluded. Reasonable claims can be settled by ITCCars Co., Ltd. in several ways--as agreed upon by ITCCars and the disputing party. Settlements typically involve, free parts replacement, partial refunds and credit issuance.

LIMITED PARTS SUPPORT

ITCCars Ltd. guarantees parts supplying support for any vehicles purchased through ITCCars. ITCCars will honor requests for original manufacturer parts and aftermarket parts. Customers must complete the ITCCars parts request form and are required to indicate the ITCCars Code Number of the vehicle which the part is for.
